3.3 Performance.
3.3.1 Insulation. The outside surface of the cup shall not exceed 125 °F (52
°C) five minutes after being filled with water heated to a temperature of 178 °F (81 °C) minimum.
3.3.2 Coffee stain. The cup sidewall shall show only slight staining after holding hot coffee (178 °F initially) for 30 minutes and being rinsed with cool, clear water. Slight staining shall be defined as readily perceptible without close examination but insufficient to markedly alter the original color of the sidewall.
3.3.3 Cola carbonated beverage stain. The cup shall show no sign of staining (sidewall), leakage, or condensation when filled with ice cubes and a carbonated cola beverage and allowed to sit for one hour. The cup shall be rinsed with cool, clear water before examining for staining.
3.3.4 Distortion. The cup shall be capable of holding liquids during normal drinking motions without any permanent distortion.
3.4 Workmanship. Cups and lids shall be clean and free from any defects which may affect appearance or serviceability. The lids shall fit the corresponding cups snugly. Cups shall be free from warpage, cracks, chips, tears, holes, cuts, blisters, stains, discoloration, and flash.
3.5 Metric products. Products manufactured to metric dimensions will be considered on an equal basis with those manufactured using inch-pound units, providing they fall within tolerances specified and all other requirements of this document are met. If a product is manufactured to metric dimensions and those dimensions exceed the tolerances specified in the inch-pound units, a request should be made to the contracting officer to determine if the product is acceptable.
3.6 Standard commercial product. The cups and lids shall, as a minimum, be in accordance with the requirements of this CID and shall be the manufacturer's standard commercial product. A standard commercial product is a product which has been sold or is currently offered for sale on the commercial market through advertisements, manufacturer's catalogs, or brochures, and represents the latest production model.
4. REGULATORY REQUIREMENTS
4.1 FDA requirements. The polystyrene material used in the cups and lids shall meet the applicable requirements of 21 CFR 177, Federal Food, Drug, and Cosmetic Act.
4.2 Recovered materials. The offeror/contractor is encouraged to use recovered materials to the maximum extent practicable, in accordance with paragraph 23.403 of the Federal Acquisition Regulation (FAR).
5. QUALITY ASSURANCE PROVISIONS
5.1 General quality statement. The products provided shall conform to the producer's own drawings, specifications, standards, and quality assurance practices. The government reserves the right to require proof of such conformance prior to first delivery and thereafter as may be otherwise provided for under the provisions of the contract.
